Missoula, MT (KGVO-AM News) – On January 4, 2023, a Missoula Police Department Officer was on duty when he saw a male leaving the area of the 1600 block of Phillips Street, walking eastbound through the alley. That address is known to law enforcement for ongoing drug-related illegal activity. As the officer got closer to the male, he recognized him as 31-year-old Danial Hendry.
The officer was aware that Hendry was on probation and had an outstanding warrant at that time. The officer contacted Hendry in the alley and informed him of the warrant. The officer then placed Hendry in handcuffs.
Prior to searching Hendry incident to arrest, the officer asked him if he had anything on him such as guns, knives, needles, or drugs. Hendry sighed and shook his head yes. He told the officer that fentanyl & “dope” was in his coat pocket. The officer began searching Hendry.
In the left chest interior coat pocket, the officer removed a folded piece of foil. Hendry said it was fentanyl. In another interior pocket of Hendry’s coat, the officer located a small plastic toy soda can. The top had a tab on it. Hendry told the officer there was a fentanyl pill in it. As the officer continued searching Hendry, Hendry told the officer his “kit” was in the backpack he was wearing. Hendry gave the officer verbal consent to search his backpack.
