MUMBAI: The dean of the J J group of hospitals should conduct the various tests they have proposed on Pune builder Avinash Bhosale within three days and send him back to judicial custody at CBI’s risk, a special CBI court said on Wednesday.
It rejected the CBI plea to have Bhosale, arrested in the Yes Bank loan scam case, examined by an independent medical board, including armed forces doctors.
“This direction will suffice the objections raised by CBI. It is because CBI has made bold allegations against JJ doctors without any basis… so, shall carry the risk of discharge of the accused,” said special judge M G Deshpande.
The CBI had said Bhosale, admitted in St George hospital since October 15, was being kept for no justified medical cause. The medical reports are vague and managed, it contended. Bhosale was initially admitted to hospital after he got Covid.
“Contention of CBI that accused Avinash Bhosale has managed to remain outside jail is baseless and without support of any sound contrary opinion against the opinion given by the JJ medical board. There is no proof regarding allegation of CBI that accused has managed to remain outside jail,” added the judge.
On January 20, the CBI had sought orders for a report from an independent medical board with army, navy or air force hospital doctors after the reports given by the JJ dean, based on opinions given by five heads of departments, said Bhosale needs to continue treatment at St George hospital after he suffered giddiness…
